Account Termination: If you abuse our website in any way, www.gopens.com can terminate your account.

Errors in Product Listings: www.gopens.com reserves the right to cancel specific orders, at out sole discretion, if a product price or product description is incorrect.
Order Cancellation: www.gopens.com reserves the right to cancel your order for any reason, including but not limited to it’s concern about the legitimacy of the order and/or the payment. This includes, but is not limited to, cancellation of a paid subscription and removal from our mailing list.

Disputes: Any dispute relating in any way to your visit to www.gopens.com or to products you purchase through www.gopens.com shall be submitted to confidential arbitration in New Haven, CT USA, except that, to the extent you have in any manner violated or threatened to violate www.gopens.com’s intellectual property rights, www.gopens.com may seek injunctive or other appropriate relief in any state or federal court in the United States, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Prices: Prices are firm.
“Vintage” Pen Limited Warrantee: All vintage pens are warranteed to be restored and operating properly, unless otherwise stated in the Catalog. Under normal use, all pens are warranteed for six months from date of purchase (this warranty specifically excludes normal wear and tear, physical damage, mishandeling, misuse, abuse, neglect, accidental breakage, operating difficulties caused by any of the above, or product loss). We will, at no charge, restore any vintage pen covered by this warrantee which ceases to operate properly. This warrantee covers the original purchaser only and, after five days, does not include shipping costs to deliver the item back to the seller.
“Modern” Pen Limited Warrantee (ca Post-1980): Our normal five day return privilege applies. Unfortunately, we often cannot restore modern pens due to lack of parts or inaccessability to the mechanisms (many modern pen companies manufacturer their pens with the plan that no restoration will ever be done — they simply plan, for example, to replace any broken pen). If we cannot restore the pen, you may still have some recourse through the manufacturer or distributor. This would be completely between you and them (in fact, any intervention by us on your behalf may intefere with their willingness to be of help to you). We can try to be of help to obtain contact information on request. Thank you for your understanding. This warrantee covers the original purchaser only and does not include shipping costs to deliver the item back to the seller.
Return Privileges: You have five (5) days from receipt of the item to return it for any reason. If you wish to return a pen, call, fax, or email to let us know. We reserve the right to withhold a refund if the item returned is not the same item and/or not in the same condition as delivered.
“Buy-back” Policy: www.gopens.com will consider (not guarantee) repurchase or trade-in of a pen it has sold. If repurchased, the buyer will normally receive 1/2 of the original purchase price. If traded-in for other pen(s), we may offer a slightly higher allowance, at our sole discretion. The pen needs to be in the same condition as when originally purchased (as determined solely by gopens.com). Gopens.com reserves the right to decline any pen for any reason, at it’s sole discretion.
Product Descriptions: www.gopens.com attempts to be as accurate as possible. However, www.gopens.com does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by www.gopens.com itself is not as described, your sole remedy is to return it in unused condition.
Our Commitment To Privacy: Your privacy is important to us. To better protect your privacy we provide this notice explaining our online information practices. To make this notice easy to find, we make it available on our homepage and at every point where personally identifiable information may be requested. www.gopens.com is responsible for the control and dissemination of your information.
The Information We Collect: This notice applies to all information submitted by yoo on our on our website or via email. The types of personal information collected are: Name, Address, Email Address, Phone Number, Credit/Debit Card Information, I.P Address, Order History, Shipping Preference and the like. While you can visit our website withour providing any personal information, you are required to supply information necessary to enter and maintain your subscription; to process your order; to be maintained on our mailing list. If you do not provide the information we will not be able to provide the product or service for you.
The Way We Use Information: We use the information you provide when placing an order to complete that order. We do not share any information with outside parties except to the extent necessary to complete an order (i.e., to our credit card prosessor; to our shipping providers), or for an insurance claim specific to your order (i.e., to an insurance company). We use email addresses to answer email we receive and to send notices regarding sales, new Catalogs, and the like. Email addresses are not shared with any third party marketer. The information is not used to make any automated decisions.
Our Mailing Lists: Consists of email addresses of Subscribers to the Quarterly Illustrated Vintage Pen Catalog, folks who have requested to be added to our mailing list either through the opt-in page on our website or by signing up at a trade show, or who have placed an order or made an email inquiry to www.gopens.com. No email address is ever sold or otherwise provided to any third party for marketing or solicitation purposes. Email addresses are shared with Campaign Monitor which transmits our bulk emails for us, for example for the announcement of sales or opening of new Catalogs.
You Can: contact us at any time to request access to the information we have about you; correct any of this information; delete any information. We will ask you to verify your identity before complying with any request.

Shipping Costs: Prices of items on the web site do not include shipping costs which will be added to each order. We pass through the carrier’s exact shipping and insurance charges. We do not add packaging or handling charges.
Insurance: We recommend insurance for any package with a value greater than $49, and signature requirement if the value is high and/or if the package is being delivered to an office, mailroom, front desk, etc.. As safe and reliable as the carriers are, none are 100% perfect. Foreign shipments are particularly vulnerable, especially to certain countries. If the buyer elects to forgo insurance, payment for the order will automatically incorporate the following disclaimer:
“We recommend full insurance for your package. Since you are self insuring all or part of your shipment, your payment for the order constitutes your agreement that if anything goes amiss with the shipment you will not seek redress from the seller, directly or indirectly, either through PayPal, your credit card, or any other means.”
www.gopens.com does not provide insurance coverage. We simply act as your agent to purchase the insurance on your behalf. It’s the same as if you were buying car insurance. Your insurance agent purchases the insurance on your behalf, and your claims are with the insurance company. www.gopens.com acts as your agent to purchase the insurance on your shipment, and will help with the claim, but the claim is made to carrier (ie. USPS, UPS, FedEx). Once the carrier verifes the loss, the claim is immediately paid by the carrier and, to the extent that any of the coverage was with our outside insurance company, they will then pay as well.
If the shipping carrier and/or our insurance company rejects a claim for loss or damage, there will be no reimbursement made, either in the form of credit, cash payment, or replacement items. If partial insurance is purchased, and the claim is honored, reimbursement will be made only to the extent of the insurance purchased.
Should your pens be lost or damaged and insurance is paid, our sole responsibility is to provide you either with the funds from the insurance settlement or with an idential item, should it be available.
Lost Shipments: If a shipped order is lost or damaged, the shipper (ie. FedEx; UPS; USPS) must conduct an investigation. Please contact us to initiate a tracer within 10 business days of the item shipping.
Damaged Shipments: If an order is received damaged, a claim must be initiated and finalized before customer compensation or product replacement is executed. You must contact us within five business days of delivery. Please hold onto your shipping box as the shipper or our insurance company may want to inspect it. See “Lost Shipments” above for more information about the claims and reimbursement processes.
Preferred Carriers: While we have preferred carriers as indicated below, we accommodate customer requests for an alternate carrier or shipping service.
Vintage Pens – United States: We prefer to ship either with USPS Priority Mail insured or via UPS Ground insured. For Post Office Boxes we prefer USPS Priority Mail insured.
Vintage Pens – Worldwide: We prefer to ship via USPS Express Mail International insured or via USPS Priority Mail International insured.
Non-Vintage Pen Items: For small quantities of items such as protective tubes and display trays, we prefer USPS Priority Mail. For larger quantities, we prefer UPS insured.
Vintage Pens Catalogs: Hard copies of Catalogs are sent via USPS First Class Mail or USPS First Class International Mail.
Ownership of Goods: The ownership of goods is transferred to the customer upon shipment.
Import Duty: We do not assess duty for an international order and international orders are subject to applicable customs, import duties and taxes, which are the sole responsibility of the customer. Please contact your local customs office for details.
Discrepancies: When your order is received, if there are any noticeable discrepancies with your item, or if the item is not what was ordered, please contact us within 5 days of receipt of your shipment to make any necessary corrections.
